What you should know.
How do I register a trademark?
Party or Public can obtain a certificate for legal purposes mentioning the
details of the TM application. To file this request, TM-46 can be selected from “Form Filing Tab” and enter the Application/opposition/rectification number for which a legal certificate is required
How much will it cost to register a trademark?
Rs. 5,499 (Rs.4,500 Govt Fee) (Individuals, Startups and Small and Medium Enterprises – SME's) and Rs.9,999 (Rs.9,000 Govt Fee) (for others) per mark per class
what are the documents required for trademark registration
1. Copy of Logo (Optional)
2. Identity Proof of Signatory.
3. Address Proof of Signatory.
4. Udyog Aadhar Registration Certificate.
5. Incorporation Certificate or Partnership Deed.
Can I use TM without registering?
The (TM) symbol actually has no legal meaning. You can use the symbol on any mark that your company uses without registering it.
When can I use the ™ symbol?
As soon as you file the application and receive an acknowledgement, you can use the ™ symbol. Once the registration process is complete, you can use the ® symbol.
Do you guarantee approval of my trademark?
It depends entirely on the government's judgement. But if it is unique, it is highly likely that it will be granted.
How long does it take to get my trademark?
It can take anywhere between 5 months to 1 year for your trademark to be approved. However, we can apply and start using the ™ symbol on same days as on the date of filling of application with the government.
